Tech companies are not above the law. It's considered forcefully when they do not follow due process to revoke a license that their customers paid money for. You don't have to hold a gun to someone's head to prove force or fear in a Robbery either. Force can be as simple as making someone do something against their will or forcefully effecting power over someone. Vudu has taken something away from their clients forcefully, against their will and without their knowledge or consent. Again, licenses many of these people are saying they paid money for. There are laws and protections that govern licenses, privacy, data. It's not excluded simply because it's not physical property. Vudu is not above the law. Just because they can do something, doesn't give them the right to.
-
lol, you are mistaken. There is a legal process that must be followed to revoke licensing rights they way they did, and if this isn't made right soon, they'll be held accountable. I've already placed 2 calls to vudu asking them to address the situation, so you're mistaken there too. Thank you for sharing your uneducated opinions though. Terms of Service don't supercede the law or our Constitution. They'll be taken to school soon enough.Originally posted by bestquality View Post
What you paid for are licenses, not property. You have no, none, zero property rights here. Let me quote Vudu's Terms of Service: "When you purchase Content, you will be granted a non-exclusive, non-transferable limited license to [...] view the Content as often as you like subject to [...] applicable restrictions"
There is no "legal process" they had to follow. That's more nonsense.
If you have receipts for your InstaWatch, take them to Vudu/Fandango and they will likely straighten it out. You haven't even given them an opportunity to address your situation. You're just another blowhard armchair lawyer, as if the world doesn't have enough of those.

Do you even know your rights as a U.S. Citizen? Vudu has no legal authority to take property from anyone. Their terms may give them the right to obtain a court order, but they do not have the right to skip due process, strong arm their customers, and take it forcefully without presenting a court order or warrant to do so. No one has the right to just take another person's possessions simply because they don't like how it was obtained. Not even a police officer has the legal right to take something from a suspects home without a warrant. There is a legal process vudu should have followed, but they did not. Digital content rights are no exception, and Vudu is not above the law or our right to be secure in our possessions. They did not do the right thing here at all.

The U.S. Supreme Court - you know, the final word on what the Constitution is and isn't - already found binding arbitration acceptable which is why most anti-consumer companies updated their terms to include it.
All you need to do is show the receipts for your disc purchases to Vudu and I'm sure they'll correct your situation. And you can take them to small claims if they don't. There won't be any class action suit.

I would love to have this in writing from them. When I spoke to them they didn't say anything about an error or correcting it. I hope you're right, because it's very upsetting.Originally posted by Blurayfan View PostI feel this needs to be said before things get out of hand. After speaking with customer service, they say this was an error and vudu is already in the process of trying to restore titles. It will just take time to reverse the damage done.

I have sent muliple messages to Vudu on this issue, and have gotten no response. Wasteland is correct, Vudu needs to communicate with us. I have always found support to be friendly/responsive. If this non-responsive approach is going to be the new standard under Fandango, I will limit my dealings with Vudu.

If so, that needs to be stated to all, not to one on a phone call, sadly, because they could be just telling you that to get you off the phone faster, and not deal with one complaining... FelipeF? If you want to get more upset read Vudu's terms and conditions. You can't sue them. Can't form a class action lawsuit either. Arbitration only. Single party arbitration. Probably easier to fight a case against the California Supreme Court that made this possible and stripped consumers of their only viable ways to go after companies ripping people off. It would have been far more fair to consumers to put a cap on Class Action lawsuit awards than to strip them away entirely.
